1. Acceptance of Terms

By using the WorkIt web portal or mobile application (operated by Prope3 Solutions Ltd, "WorkIt", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Role of the Platform

WorkIt is a technology marketplace that connects gym operators and fitness centers ("Gyms") with fitness members ("Members").

• Not a Gym: WorkIt is not a gym, does not operate physical fitness centers, and does not employ physical trainers or gym staff.
• Platform Liability: We are not liable or responsible for any injuries, accidents, health issues, or disputes arising from services, equipment, or facilities provided by gym operators listed on our platform.
• Service Quality: Gyms are solely responsible for keeping their listings, facilities, operating hours, and equipment descriptions accurate.

3. Membership Payments & Refunds

Members pay for gym memberships through WorkIt using secure transaction paths facilitated by Paystack.

• Refund Policy: All subscription fees paid are generally non-refundable. Refund disputes, membership cancellations, or complaints about gym services must be settled directly between the Member and the respective Gym operator.
• Mediation: While we may step in to mediate disputes or flag bad actors, WorkIt is not financially or legally liable for gym service failures.

4. Gym Owner Accounts & Onboarding

Gym owners who list their gyms agree to provide accurate registration, location, and banking details.

• Payouts: Revenue generated from memberships settles directly into the gym's verified bank account next business day (T+1) via Paystack subaccounts.
• Right to De-List: Prope3 Solutions Ltd reserves the absolute right to suspend or remove any gym listing that violates Nigerian laws, receives excessive member complaints, or fails to honor active memberships.

5. Intellectual Property

The WorkIt logo, technology, design system, source code, and assets are the proprietary intellectual property of Prope3 Solutions Ltd. You may not copy, reverse-engineer, or distribute any part of the platform without our express written consent.

6. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any legal action or proceeding arising under these terms shall be subject to the exclusive jurisdiction of the courts of Nigeria.
